Arthrex U.S. Product Warranty

The following warranty terms are in effect at the time of publication. Arthrex reserves the right to modify any of the warranty terms below. For the latest warranty information, it is best to contact Arthrex directly at 866-267-9138 (toll-free) or 239-552-2410 (direct).

Arthrex warrants its products against breakage or failure due to defects in workmanship to the original purchaser, who purchases product through an Arthrex expressly authorized distribution channel, for the warranty period set forth below:

 

Description

New Product Warranty

 

Synergy Vision™, SynergyID, SynergyUHD4™, and SynergyInsufflation™ Consoles

One (1) year from the date buyer receives the product; seven (7) years from the date buyer receives the product on the LED light source.

Synergy Vision, SynergyID, SynergyUHD4, and SynergyInsufflation Tablets

One (1) year from the date buyer receives the product.

Arthrex Field Service Technician Labor Work

Ninety (90) days after the completion of labor work performed by an Arthrex Field Service Technician

Synergy Camera Heads

One (1) year from the date buyer receives the product; seven (7) years from the date buyer receives the product against autoclavable failure.

Synergy Scopes and Hardware

Two (2) years from the date buyer receives the product.

Synergy Monitors

From the date buyer receives the product, three (3) year warranty for models AR-3250-3206, AR-3250-3207, AR-3250-3208, AR-3250-3209, and AR-3250-3210, and one (1) year warranty for models AR-3250-2701, AR-3250-3211, and AR-3250-3212.

Synergy Vision Connect™, Synergy Matrix™, and Synergy Matrix Core Video Integration Systems

The video integration system is warrantied to be in good working order on the date installation is completed and to be free from defects in workmanship and materials for one (1) year from such date.

Endoscopic Spine Console and Footswitches

One (1) year from date buyer receives the product.

Arthroplasty

No warranty.

TRIMANO® Arm Holder and TRIMANO FORTIS® Support Arm

Two (2) year warranty from the date buyer receives product. Repaired or refurbished items: One (1) year warranty from the date the buyer receives the product.

Arthrex Hand Instruments

Lifetime warranty against manufacturing defects and materials for the original owner so long as the product was purchased from an authorized distributor.

Repaired and Refurbished Devices for Imaging and Resection

Six (6) months.

Arthrex OEM Products

If Arthrex is acting as an OEM product reseller, the original manufacturer's warranties, if any, shall apply. Arthrex will direct any warranty claims on OEM products to the OEM manufacturer.

Certified Pre-Owned

SynergyUHD4 Consoles

One (1) year from the date buyer receives the product

Certified Pre-Owned

SynergyUHD4 Camera Heads

One (1) year from the date buyer receives the product

 

Limitation of Warranty

Unless otherwise set forth above, Arthrex Inc. warrants its products against breakage or failure due to defects in workmanship to the original purchaser, who purchases product through an Arthrex expressly authorized distribution channel, for a period of one year from the receipt of the product by the original purchaser. If a product breaks or fails to function in normal surgical use, due to defects in material or workmanship, Arthrex will, at its sole option and after examination by Arthrex’s Quality Management Department, repair or replace the product at no charge. This warranty does not cover damage caused by misuse or mistreatment of the product. This warranty does not cover damage to the product caused by neglect or accident. This warranty is void if the product has been modified or altered in any manner or if the product has been repaired, or attempted to be repaired, by anyone other than Arthrex.

THIS WARRANTY DOES NOT EXTEND TO ANYONE OTHER THAN THE ORIGINAL PURCHASER WHO PURCHASES PRODUCT THROUGH AN ARTHREX EXPRESSLY AUTHORIZED DISTRIBUTION CHANNEL, IS NONTRANSFERABLE AND STATES YOUR EXCLUSIVE REMEDY. ARTHREX SHALL NOT BE LIABLE FOR LOSS OF REVENUE OR PROFITS, FAILURE TO REALIZE SAVINGS OR OTHER BENEFITS, OR ANY OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE, MISUSE OR INABILITY TO USE THE PRODUCT, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, AND EVEN IF ARTHREX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO RECOVERY OF ANY KIND AGAINST ARTHREX SHALL BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE PRODUCT.

 

DISCLAIMER OF WARRANTY

THERE ARE NO WARRANTIES OTHER THAN THOSE DESCRIBED ABOVE. THERE ARE NO IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow limitations on the duration of an implied warranty, so all of the above limitations may not apply to you.

 

Governing Law and Venue

This warranty and any action relating to or brought under this warranty are governed by the laws of the State of Florida regardless of any choice of law principles. Any legal action to enforce this warranty against Arthrex must be brought in a court of competent jurisdiction located in Collier County, Florida.

 

How to Get Service

In order to receive the benefit of this warranty, the original purchaser must notify Arthrex of the breakage or failure due to defects in materials or workmanship. Notice must be made by contacting Arthrex at Support@arthrex.com (email), 800-391-8599 (phone), or 239-552-4610 (fax). Contact must be made within 30 days of the expiration of the warranty period set forth above. Upon receiving notice from the original purchaser, Arthrex will provide a Return Authorization Number for return of the product to Arthrex for examination by Arthrex’s Quality Management Department.

  • Customers are entitled to prepaid return freight costs paid for by Arthrex.
  • Warranty claims: Customer shall provide an up-front purchase order (PO) for the charge of the replacement product. Upon Arthrex’s receipt of the PO, Arthrex will ship the replacement product to the customer. In the event a manufacturer or material defect in workmanship is found, Arthrex will provide a full credit refund to the customer.
  • Out of the Box Warranty Claims will be accepted on devices that have shipped the customer 90-days or less at the time of service request
    • Out of the Box Warranty Claims on new products will receive a new product as a replacement
    • Out of the Box Warranty Claims on refurbished products will receive a refurbished product as a replacement
  • If the defective device is not returned within 30 days of receiving its replacement, a nonreturn fee will be invoiced. A credit for the nonreturn fee is available if the device is returned within 180 days of receiving the replacement device. After 180 days, a nonreturn credit will no longer be available.
  • The device returned must be the same as the one in the claim. Due to FDA evaluation requirements, a different device cannot be returned as a substitute for the complaint device to avoid the nonreturn fee.
  • Altered products: Customer shall be responsible for payment of an unauthorized repair fee. Due to quality related and product safety issues, altered products will not be returned to customer.
